FISA Courts and Their Role in Ensuring National Security

We return to the Hope Club for our season-ending presentation with Judge Bruce M. Selya.  

The Foreign Intelligence Surveillance Act (FISA) of 1978 established a secret court to consider government requests to conduct the special category of “foreign intelligence” surveillance in the United States.  

Legislation passed since the terror attacks of 9/11 has removed some barriers to domestic intelligence gathering and allowed the bulk collection of communication data of ordinary Americans.

How do the FISA courts function and what checks and balances are in place?  And how do we protect the privacy of Americans while empowering law enforcement with the technical tools and information they need to combat an increasingly sophisticated enemy?

Judge Selya was appointed to the First Circuit Court of Appeals in October 1986 and assumed senior status on December 31, 2006. He received his undergraduate degree from Harvard University in 1955 and his law degree from Harvard Law School in 1958.
